*** Orders from France ***
warning: Shippment delays must be higher due to the Covid 19 and Lockdown (Postal services access restricted)
All shipments on French territories are made via priority tracked letter, colissimo 48h, colissimo with insurance and signature, or postal relay. Shipment is made according to items ordered, (see processing times and shipment for each item on product descriptions). If your order is urgent, or is due for a special day, please contact us before purchasing in order to see if it is possible to urge the order. Delays indicated near shipping methods are an estimation after deposit at the post office.
You must provide a clear and complete and updated address when yu check out, Name, first name, number, street name, building, apartment, door, digital code and other details necessary for the proper delivery of your order. Any failure may cause an order cancellation . If you your order is shipped to the wrong address, you will be responsible for its loss ,we cannot refund or ship again for free.It will be the same is if you "forget" to pick up your package at the post office.
The price of shipping costs is fixed and decided according to prices of current postal services, therefore they are not negotiable. You are responsible for the choice of your shipment. If you have had issues, in the past, about stolen or damaged parcels, we encourage you to take options with signatures (insured parcel or parcel relay). Otherwise, if the package is written "delivered" and you do not have it, we cannot act (only open a dispute with postal services).
*** Internantional shipping***
International shipments are made by tracked mail, international tracked letter, small packets( priority package with delivery option with signature if it's necessary) and Delivengo, up to 2 kg. Beyond 2 kilos (like 3 or more candles) shipments are made Colissimo international (with or without signature), prices defined in the item description.
These shipments are made almost two times a week, but as international shipment maybe be complicated and so it's difficult for us to give you a deadline for delivery. Delivery times could be affected by social movements, climatic conditions, High busy period (end of year , christmas), and custom checking. Therefore it could be 3 to 5 days depending on whether you are near France, and 7 days to sometimes 4 weeks if you live far away.
Trackings numbers are provided right after shipping ,if you have some issues in particular with packets blocked at customs (exchange office) you can directly contact the postal services of your country, by providing the number. You can track your packet directly on the postal site of your country or here
**** FOR ALL SHIPMENTS OUTSIDE EUROPEAN UNION ****
For any shipment outside European Union (UK, Switzerland, Norway, etc.) You assume full responsibility for customs duties and taxes. These costs are due and specific to where you live.
No one is supposed to ignore the law on the import of goods into their country.
If you have questions , we encourage you to contact your customs services. Customs forms will be filled before shipping.
No merchandise values will be reduced or falsified at your request. So please don't ask us to wright "gift" on your packet to avoid taxes, we are registered business and we don't want to lost our licence.

*** Cancellation and return policies ***
According to articles L. 121-20 from EU Consumer Code, a customer have 14 days to cancel an order from the delivery , and ship it back to the seller for refund or exchange , without any justifications or penalties.

To cancel an order you can send a mail before 14 days with Name, First name, order number, and items.
Please don't return anything without our agreement before.
Goods must be returned under 14 days after agreement ,by the same way of shipping (priority tracked packet) et you must provide US the tracking as soon as possible. You are responsible if the order is lost or dammage during returned goods, so we have to ask to be careful when you will pack the order.
Customer must assumes charges for returning an order . The items must be returned in the original wrapping , non used and in good conditions.
Items used ,damaged , untagged, dirty or incompletes will not be refunded.
In case a customer request his withdrawal right, the seller must refund or credit to the customers without penalties. (note: if the withdrawal right is applied after shipment, customer will have to send back to be refunded)
.Refund is due within a delay of maximum of 30 days from the day of delivery .
The withdrawal right can't be applied to perishable goods nore customs orders.
These policies will applied too for products under sanitary issues like earrings , underwears, or used candles.
If an item was damaged during shipment, or you think it's damaged, don't accept the packet. When you accpet it, responsabilities are transfered to you. You will need to prove it was shipment and not you, who damaged the item.
If ant item is damaged contact us as soon as possible, with pictures (shipping box and items), we could replace, if it could not be replaced within 10 days,(some piece could not be crafted again, or supplies are missing) it wil be refunded.
In case of abusive returns , agressive or insulting behaviour , the seller keep right to cancel an actual orders and next ones.

These presents policies concerns all goods sold by The bat i the hat shop , 5 rue du Moinille 02200 PERNANT , and on all marketed products on this website clothing, jewelry, candles, home decor...

Our prices are dislay in EURO with VAT included (VAT and other EU taxes applied on the day of checkout), processing and shipping fees are not include.
In case of an order in placed outside from FRANCE or out of European your are responsible for importation and so you must know your country laws about importating goods. Some cutoms fees and importation taxes must be applied by your governement and could be due . These fees are nothing to do with The bat in the hat shop, you need to ask directly with our own coutry authorities.
These fees are your responsabilty ,we do not have any control over customs and we can't assume importation duties for you. You should try to have more informations about importation with your local authorities.
All orders are due in Euros € (a currency converter is available on the website, and you can pay with PAYPAL if you need to pay in another currency)
The bat in the hat shop keep right to modify his prices anytime, but the product will be billed on the price base during checkout et and under availabilty .
All products still the property of The bat in the hat untill payment is fully completed.

The bat in the hat shop keep the right , anytime , to no accept or cancel an order or a payment et especially in case of stock issues, or difficulties with the present order.

All orders made on the website The batinthehatshop.com assume you agreed to our prensent shop policies. All order placed will assume you to accepted all the shop policies without any restrictions .
All datas gives to us during a purchase or when an order is placed will be a transaction proof and will linked us by contract.

Article 5 - Payment
Placing an order involve the obligation to fully pay the indicated price.

The credit card will be charged only when the order is placed. IF an item is missing or damaged before shipment , we will inform you as soon as possible and:
-You could choose a refund for the item .
-We could replace it with another item like the product you ordered , or same price product.
-Cancel and fully refund all the order.
Article 6 - Cancellation and withdrawal right.

Unless arrangements are made by messages, you cover the cost of the return (exept if goods are dammaged during shipping , or if the seller send the wrong item. We will asked you pictures in these cases, items , cardbox and wrapping)
In case of withdrawal right requested The bat in the hat will proceed to a fully refund under 14 days after receiving the email, and by the same payment method the customer used with original order.
Withdrawal right exceptions
Acoording to article L.121-21-8 From EU consummer code , withdrawal rights could not be applied to:
The cancellation delay is out the deadline (14 days)
Products are considered ad Custom -made with some specifications from the customer /customization (custome size, colors...)
Products could quickly perish.
Products unsealed (untagged, or used during more than 12 hours )by the customer after delivery and so could not be returned pour sanitary and hygienic issues (earrings, underwears, used candles)
Items that are not provided by The bat in the hat shop.
Article 7- Availabilty
All of our products display on the website Thebatinthehatshop.com are available for purchase only within the limits of available stocks . For all products not in stocks, availabilty is only possible according to our suppliers stocks.
If an item is missing , damaged, or not in stocks after placing your order, we will contact you as soon as possible. Your order will be automatically cancelled and refunded.
Furthermore , the website Thebatinthehatshop.com is not dedicated in selling mass products or big quantities (as we are small business and all items are made by hand). And so The bat in the hat keep the right to refuse orders with more than 10 same pieces at the same time. If you need lager quantities , please contact us to know if it's possible.
Article 8 - Delivery
The products are delivered to the address provided by the customer during ordering process, and considered to be correct and updated. If you provided an incomplete or not updated adresse, your are responsible for a wrond delivery or lost parcel.
In case of shipment delays, an email will be sent to you to inform of apossible consequences on delivery times which had been indicated during checkout.
According to EU laws, in case of delivery delays , you have possibility to cancel your order under the terms and conditions defined by article L 138-2 From Consumer Code.
Deliveries are made by the postal carriers you choose (carrier, signature, insurance...), the company The bat in the hat shop cannot be responsible for delivery delays , customs controls , customs duties...
Article 9 - Guarantee
All our products are under the French legal conformity gurantee (especilally for hidden defects) provided for by articles 1 641 and from Civil Code. In case of non-conformity of a sold product , it may be returned, exchanged or refunded
All complaints, requests for exchange or refund must be made by Mail, within 14 days from delivery.
The products must be returned in his orginal condition as you received it, with all the elements (accessories, packaging, instructions ...). Shipping costs will be refund according to informations on the shipment invoice and official post rates.
these present dispositions from this article do not prevent you from benefiting right of withdrawal provided for in article 6
Article 10 - Responsabilty
The products offered on The bat in the hat shop comply with current French legislation. The bat in the hat cannot be responsible in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services that you plan to order.
Furthermore, The bat in the hat company cannot be responsible for damage resulting from improper use of product purchased.
Finally, The bat in the hat cannot be responsible for any inconvenience or damages inherent in misuse of Internet, in particular a break in service, external intrusion or the presence of computer viruses.

The language of this contract is in English but the company is based in France. These conditions of sale are under French consurmer law. In cas of a dispute, the French courts only will have jurisdiction. Any dispute relating to the interpretation and execution of these general conditions of sale is uder French law. In absence of an amicable resolution, the dispute will be brought before the Commercial Court of Soissons
